Online dating sites Anastasia International accused EM Online Ltd. dba Elena’s Models with brand name violations, fake advertising, tortious interference and unjust competition, inside the New York City Federal Court. For their web-site, Anastasia employs the internet domain names Anastasiadate along with Anastasiadate.com. Despite the misconception that EM Online are based in America, they’re truly operating out of Australia.
“Anastasia, who have brought EM Online to the court, matches American men with Russian and Ukrainian girls. The most highly targeted area of the states is NYC”, claims the report. “EM Online precisely infringes upon Anastasia’s market. We have the mandatory data to think that EM Online either is controlling, or is supporting, internet sites called: ‘anastasiadatefraud.com’ and ‘ruadventures.com’The websites’ owners can’t be determined due to a proxy service being used, which makes things suspicious as you would expect. To make matters much more distrustful, these web sites redirect whomever is viewing them to elenasmodels.com. The foundation of the bogus marketing accusation stands because of the fact the two internet sites accuse Anastasiadate of very carefully and consistently scamming customers and deceive the clientele when choosing their services, and after that go on to claim that the accused, elenasmodels.com, is really a totally safe and reliable dating site. “The anastasiadatefraud.com website purports to show extracts from e-mails authored by women with profiles on Anastasiadate.com. The email messages are all recurring, and report that girls shown on Anastasiadate.com aren’t really women trying to find love, according to anastasiadatefraud.com they are really ladies who are paid to talk with men The emails look to be quite fake, and so anastasiadatefraud.com can be charged with false advertisement. Anastasiadate’s customers are guaranteed that the women they’re talking with are 100% genuine women.”
The complaint states that EM Online are voluntarily false advertising, given that they know that what they are saying is bogus, and that the e-mails were written with the only objective of wrongly ceasing Anastasiadate’s business. Anastasia claims Elena’s uses the ruadventures.com website to promote its own organization and submit untrue, harmful information about competitors. “While trying to hide underneath the cover of an independent, unbiased forum site, ruadventures.com actually selectively picks out the positive comments about Elena’s Models and promotes that, while trying to throw other competition aside. The web site contains falsehoods about customers’ use of the Anastasiadate service which .. has been designed by Elena’s Models,” or so the accusation says.
According to Anastasia, ruadventures.com has also made unlawful use of the copyrighted logo to appeal to customers. “As a result of how search engines like google work, using the Anastasiadate’s trademarks has made ruadventures.com much more visible on Google, Yahoo, Bing and other search engines,” according to the complaint. Anastasiadate are looking for a cease and desist charge for the actions of EM Online. It is represented by Richard C. Yeskoo with Yeskoo Hogan & Tamlyn.
Anastasiadate’s services include meeting “some of the planet’s most desirable girls!” “Anastasiadate provides the world’s greatest online dating service,” the site says. It identifies itself as “the easiest method to find real women online, using the best consumer protection entirely on a dating site.”
