Web Pages which provide mail-order brides from Russia and Ukraine are battling it out in Federal Court
Anastasia International accused EM Online Ltd. dba Elena’s Models of trademark violations, incorrect promotions, indirect interference and unjust competition, inside the New York Federal Court. For their webpage, Anastasia takes advantage of the internet domain names Anastasiadate in addition to Anastasiadate.com. Despite the misconception that EM Online are based in America, they’re really based in Australia.
“The company leading this lawsuit, Anastasia, offer a service in which guys from the U .S. are matched up with women from Russia or Ukraine. The most highly targeted section of the states is New York”, claims the report. “EM Online directly infringes upon Anastasia’s market. We have the essential info to assume that EM Online either is controlling, or is supporting, websites known as : ‘anastasiadatefraud.com’ and ‘ruadventures.com’As a result of a proxy service, these web sites are disguising the identity of their owners. To make matters more dubious, such sites reroute anyone who is viewing them to elenasmodels.com. These websites accuse Anastasiadate of systematically perpetuating frauds and bogus deceptions upon its clientele, and then suggest that the customers use Elena’s Models, which allegedly doesn’t follow these procedures. “The anastasiadatefraud.com website purports to show extracts from e-mails written by women with user profiles on Anastasiadate.com. The e-mail extracts all have a common message – the ladies featured on Anastasiadate.com are not truly hunting for a relationship with men from the United States, but instead are contract workers paid to correspond with Anastasia customers and break their hearts. The emails from these women are evidently fake, making these claims false. Anastasiadate’s clients are guaranteed that the women they’re talking with are 100% genuine women.”
The complaint states that EM Online are voluntarily false advertising, simply because they know that what they are saying is bogus, and that the emails were composed with the only objective of unfairly preventing Anastasiadate’s business. As outlined by Anastasia, Elena’s Models is using its other site, ruadventures.com, to harm other companies and advertise its very own, in an exceedingly unjust manner. “While attempting to hide beneath the cover of an independent, neutral forum site, ruadventures.com actually selectively picks out the positive comments about Elena’s Models and promotes that, while attempting to blast other competition out of the way. The website contains falsehoods about customers’ use of the Anastasiadate service which .. has been manufactured by Elena’s Models,” as is written on the complaint.
According to Anastasia, ruadventures.com has also made illegal utilisation of the copyrighted logo to attract clients. “Through self referential tags, while using Anastasia’s trademarks, the websites are now linked to Anastasiadate, which has made them popular search engine results,” according to the complaint. Anastasia is seeking a primary and permanent injunction, and treble and punitive damages. Anastasia are being defended by Richard C. Yeskoo.
Anastasiadate’s services include getting together with “some of the world’s most desirable ladies!” “Anastasiadate offers the world’s best internet dating service,” according to the site. It describes itself as “your most effective way to a stack of responses, legitimate and caring women, 24/7 customer satisfaction and security.”
An anonymous writer, posting on anastasiadatefraud.com, claims to know every secret behind Anastasiadate. According to him, Anastasiadate hires girls who are paid to speak with the clients. A girl form the Ukraine told him these details, and that’s why he’s now revealing it to the world. For chatting and emailing men, these women are promised a high income along with other benefits. The requirements required for this type of “job” are: to be over 18 years and to be literate in English and in computers.
