Two internet sites, which offer online dating services, have taken each other to Federal Court
Anastasia International accused EM Online Ltd. dba Elena’s Models with brand infractions, mistaken marketing, tortious interference and unjust competition, inside the Manhattan Federal Court. Anastasia is a U.S based dating company, whilst EM Online is an Australian based online dating webpage. Both of them, however, concentrate on the U.S market. In turn, one can possibly see how both are contending for the same market.
“The company leading this particular lawsuit, Anastasia, provide a service by which males from the U .S. are matched with women from The Russian Federation or Ukraine. New York City has the main market for Anastasia”, the plaintiff states. “Elena’s Models can be described as a lead opponent of Anastasia. It operates the elenasmodels.com internet site and competes for the exact same prospective customers as Anastasia in the United States. “Based upon info and belief, Elena’s Models manages or sponsors sites known as ‘anastasiadatefraud.com’ and ‘ruadventures.com.'”. As a result of a proxy service, these web sites are disguising the identity of their owners. Having said that, they direct customers to the elenasmodels.com website. These websites accuse Anastasiadate of carefully perpetuating frauds and deceitful deceptions upon its clientele, and then suggest that the clients use Elena’s Models, which allegedly does not follow these practices. “The anastasiadatefraud.com website proposes to show extracts from e-mails written by women with user profiles on Anastasiadate.com. The e-mail extracts all have a common message – ladies featured on Anastasiadate.com aren’t truly trying to find a relationship with men from the United States, but rather are contract employees paid to correspond with Anastasia clients and break their hearts. The emails from these females are certainly fake, making these accusations false. Anastasiadate’s clients are assured that the women they’re chatting with are 100% authentic women.”
The complaint states that EM Online are voluntarily false advertising, given that they know that what they’re saying is bogus, and that the emails were composed with the only purpose of wrongly halting Anastasiadate’s business. Anastasia claims Elena’s uses the ruadventures.com web site to showcase its own organization and publish untrue, damaging information regarding competitors. “The ruadventures.com website, whilst acting to be an independently made forum for the exchange of information about international online dating services, in fact is just choosing and posting negative information about Elena’s Models’ competitors (including Anastasia) and reviews that are positive about Elena’s Models service. The internet site retains plenty of false advertisement about Anastasiadate, that has ultimately been mucked around with by EM Online,” or so the accusation says.
Ruadventures.com has unlawfully used elements of Anastasia’s copyrighted logo, as outlined by Anastasia. “Due to how search engines work, while using Anastasiadate’s trademarks has made ruadventures.com much more visible on Google, Yahoo, Bing and other search engines,” the complaint states. Anastasiadate are searching for a cease and desist charge for the actions of EM Online. Anastasia are being defended by Richard C. Yeskoo.
Anastasiadate.com, checked Thursday, offers American men the ” the planet’s most beautiful girls!” “You can not locate a superior internet dating service any place else,” the site says. It identifies itself as “the simplest way to find real women online, with the best consumer protection entirely on a dating site.”
On the anastasiadatefraud.com site, also checked out Thursday, an anonymous author says he will tell readers “only the truth” about Anastasia date. Anastasiadate pays women to log on and pose as single women searching for love, and are paid to do this by the same company, according to him. He claims he knows this just because a woman he talked with in Kiev had informed him how Anastasiadate works. He claims the third-party agencies assure women “high profits and flexible schedule” to email and chat with American men. The only real listed requirements are to be 18 or older, to know English, and to know how to work with a computer, according to the website.
The girl might have been working for Elena’s Models, as she actually advised the website to him!
